                Detailed Summary
            

            
By S.O. 5214(E) dated 4 December 2024, issued under sub-section (1) of section 20E of the Railways Act, 1989 (24 of 1989), the Ministry of Railways (Western Railway, Construction Organisation) declares that the land specified in the Schedule, in Mahesana District, Gujarat, is acquired for the Special Railway Project 'Vijapur-Ambaliyasan Gauge Conversion Project'. The notification follows the prior declaration of intent to acquire, S.O. 5198(E) dated 7 December 2023 under section 20A(1) of the Act, whose substance was published in the 'Indian Express', 'The Times of India' (English), 'Divya Bhaskar' and 'Gujarat Samachar' (Gujarati) on 16 December 2023 under section 20A(4); objections that were received were considered and disallowed by the competent authority, whose report was then submitted to the Central Government under section 20E(1). Under section 20E(2), the land vests absolutely in the Central Government, free of all encumbrances, on publication of this notification in the Official Gazette. The Schedule lists 26 survey-number parcels, mostly private agricultural land plus one Government-land parcel (Survey No. 102, 1,016.29 Hectare as stated), in Gerita Village, Vijapur Taluka, Mahesana District, with individual areas as recorded in the Schedule, held by numerous named members of the Chauhan and Yagnik families. NOTIFICATION
Mumbai , the 4th December-2024
S.O. 5214(E).—Whereas, by the notification of the Government of India, in the Ministry of Railways
(Railway Board), Number S.O. 5198(E), dated 7thDecember, 2023 published in Gazette of India, Extraordinary, Part
II, Section 3, Sub-section (ii) and issued under sub-section (1) of Section 20A of the Railways Act, 1989 (24 of 1989)
(hereinafter referred in as the said act), the Central Government declared its intention to acquire the land specified in
the Schedule annexed to he said notification for the Purpose of execution, maintenance, management and operation of
the Special Railway Project namely, Vijapur-Ambliyasan Gauge Conversion Project (Western Railway) in the District
of Mahesana in the State of Gujarat;
And, whereas, the substance of the said notification was published in the daily newspapers namely the
“Indian Experess”, The Times of India” (English), “DivyaBhaskar”& “Gujarat Samachar (Gujarati) dated 16th
December ,2023 under sub section (4) of section 20A of the said Act;
And, whereas objections were received and same have been considered and disallowed by the Competent
Authority and accordingly orders have been passed;
And, whereas, in pursuance of sub-section (1) of section 20E of the said Act, the competent Authority has
submitted its report to the Central Government;
Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers
conferred by sub-section (1) of section 20E of the said Act, the Central Government hereby declares that the lands
specified in the Schedule Annexed hereto shall be acquired for the aforesaid purpose;
And, further, in pursuance of sub-section (2) of section 20E of the said Act, the Central Government hereby
declared that on publication of this notification in the Official Gazette, the land specified in the Schedule annexed
hereto shall vest absolutely in the Central Government free from all encumbrances.
