This notification of Bank of India (F. No. HO:HR:IL:2023-2024:422, Mumbai, dated 27th October 2023), issued under Section 19 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 (5 of 1970) by the Bank's Board of Directors after consultation with the Reserve Bank of India and with the previous sanction of the Central Government, promulgates the "Bank of India Officer Employees' (Discipline and Appeal) Amendment Regulations, 2023," effective from the date of publication in the Official Gazette. The Regulations substitute the Schedule to the Bank of India Officer Employees' (Discipline and Appeal) Regulations, 1976 [see Regulation 3(b), 3(g), 3(n), 3(o)], setting out the Disciplinary, Appellate and Reviewing Authority applicable to each officer grade, ranging from Junior/Middle Management Grade Scale I-III (Zonal Manager/Assistant General Manager as Disciplinary Authority) up to Top Executive Grade VIII (Managing Director and Chief Executive Officer or Executive Director as Disciplinary Authority, with the Board as Reviewing Authority), and provides for delegation and continuation of authority in specified circumstances. The notification (ADVT.-III/4/Exty./529/2023-24) was signed by Shampa Sudhir Biswas, General Manager (HR), and notes ten prior amendments to the principal regulations dated between 1988 and 2008.

HO:HR:IL:2023 -2024:422. —In exercise of the powers conferred by section 19 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 (5 of 1970), the Board of Directors of the Bank of India, after consultation with the Reserve Bank of India and with the previous sanction of the Central Government, hereby makes the following regulations further to amend the Bank of India Officer Employees’ (Discipline and Appeal) Regulations, 197 6, namely: — 1. Short title and commencement. —(1) These regulations may be called Bank of India Officer Employees’ (Discipline and Appeal) Amendment Regulations, 2023. (2) They shall come into force from the date of their publication in the Official Gazette. 2. In the Bank of India Officer Employees’ (Discipline and Appeal) Regulations, 1976, for the Schedule, the following Schedule shall be substituted, namely: – “SCHEDULE [See Regulation 3(b), 3(g), 3(n), 3(o)] S.No. Name of the Post Disciplin ary Authority Appellate Authority Reviewing Authority (1) (2) (3) (4) (5) 1. Officers in Top Executive Grade - VIII Managing Director and Chief Executive Officer or in case of his absence, the Executive Director holding Human Resources Portfolio Committee of the Board Board Note: 1. In absence of the authority specified in above column nos. (3), (4) and (5), the next higher authority, as applicable, is empowered to exercise the powers of Disciplinary or Appellate or Reviewing Authority, as the case may be. 2. Wherever the Disciplinary or Appellate or Reviewing Authority is appointed or nomi nated by designation, the authority officiating in such designated post, shall ipso facto exercise the authority of Disciplinary or Appellate or Reviewing Authority, as the case may be. 3. Wherever there are more than one officer/s of the same designation wh o can function as Disciplinary or Appellate or Reviewing Authority or where such authority is not in a position to function as such or for any reason whatsoever, then : - I) The Chief General Manager – Human Resources and in his absence Executive Director, hol ding Human Resources Portfolio or Managing Director and Chief Executive Officer, by general or special order shall empower : a) an officer not below the rank of Zonal Manager in Scale – VI or Deputy General Manager to nominate which officer of the appropriat e Scale, as specified in this Schedule, shall function as 6 THE GAZETT E OF INDIA : EXTRAORDINARY [PART III—SEC.4] Disciplinary Authority in respect of officers in Junior Management Grade Scale - I, Middle Management Grade Scale - II and Middle Management Grade Scale - III. b) an officer not below the rank of Gener al Manager in Scale - VII to - i) function as Disciplinary Authority in respect of officers in Senior Management Grade Scale - IV and Senior Management Grade - V; ii) nominate which officer of the appropriate Scale, as specified in the above Schedule, shall function as Appellate Authority in respect of officers in Junior Management Grade Scale - I, Middle Management Grade Scale - II and Middle Management Grade Scale - III. II) The Executive Director, holding Human Resources Portfolio or in his absence Managing Director and Chief Executive Officer, by general or special order shall empower - a) an officer not below the rank of Chief General Manager in Scale - VIII to - i) function as Disciplinary Authority in respect of officers in Top Executive Grade Scale - VI; ii) function as Appellate Authority in respect of officers in Senior Management Grade Scale - IV and Senior Management Grade - V; iii) nominate which officer of the appropriate Scale, as specified in the above Schedule, shall function as Reviewing Authority in respect of officers in Junior Management Grade Scale - I, Middle Management Grade Scale - II and Middle Management Grade Scale - III. 4) The Disciplinary or Appellate or Reviewing Authority for Officer Employees’ posted in establishments outside India and fo r those on deputation, shall be the same as for Officer Employees posted in Head Office. 5) Where disciplinary action is required to be taken against more than one officer, in Junior Management Grade or Middle Management Grade or Senior Management Grade i.e. up to Scale - V, in respect of a common misconduct or a common transaction or series of transactions, then the Disciplinary Authority for the senior most officer concerned is also empowered to initiate disciplinary proceedings against all such officers. Co rrespondingly, Appellate and Review Authorities for all such officers will be same as those for the senior most officer. 6) Any proceedings which have been initiated but have not yet been completed by the appropriate authority on the date of coming into force of this Schedule, shall be continued or disposed of as far as may be by the same authority who initiated such proceedings.” SHAMPA SUDHIR BISWAS , General Manager (HR) [ADVT. -III/4/Exty./ 529/2023 -24] Note: The principal regulations were subsequently ame nded vide following notifications, namely: — Serial.
