By notification S.O. 3823(E) dated 28th August 2023, the Ministry of Road Transport and Highways, referencing its earlier notification S.O. 2297(E) dated 26th September 2008 (which entrusted National Highway No. 218, including its Bijapur-Jevargi-Gulbarga extension terminating near Homnabad, to the State of Karnataka), exercises powers under section 7 of the National Highways Act, 1956 (48 of 1956) read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 to levy fee on mechanical vehicles at 60% of the base rate for the two-lane-with-paved-shoulder Bijapur-Hubli Section (design km 4.400 to 56.300, existing km 4.627 to 56.30) of NH 218 (New NH-52) in Karnataka, covering a net road section length of 47.274 km and an equivalent structure length of 2.51 km (physical structure length 0.251 km, including the Doni River Major Bridge at chainage 18.900-19.151 km), and authorises the National Highways Authority of India to collect the fee at the Fee Plaza at Km 22.600 (near Mulawad village, Bijapur District). Base-year 2022-23 rates range from Rs. 0.96/km for cars to Rs. 6.22/km for oversized vehicles (seven-plus axles); the monthly pass for local non-commercial vehicle owners within 20 km of the plaza is Rs. 330 for 2023-24; commercial vehicles registered in the plaza's district pay 50% of the specified rate where no alternative road exists; and the estimated capital cost of the project is Rs. 220.40 crore, with fee revision to 40% of rates after capital-cost recovery. L. -33004/99 EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 3662] NEW DELHI , MON DAY , AUGUST 28, 2023/ BHADRA 6, 1945 CG-DL-E-31082023-248429 (1) (2) 60% 60% क ु ल 0.251 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 2 8th August, 2023 S.O. 3 823(E).—Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 2297 (E) dated the 26th September 2008 issued under Section 5 of the National Highway Act, 1956 (48 of 1956), the C entral Government has entrusted the stretch of National Highway No. 218 (including extension from Bijapur and connecting Jevargi -Gulbarga and terminating at its junction with NH 9 near Homnabad) situated within the State of Karnataka to the State Government of Karnataka; Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee on mechanical vehicles at sixty percent of base the rate spe cified in column (2) of the Table 1 for net road section length of 47.274 km and for equivalent structure length (having length more than 60m) of 2.51 Km (having length of 0.251 km) on the type of vehicles specified in column (1) of the Table 1 below for u se of two lane with paved shoulder of Bijapur – Hubli Section from design kilometer 4.400 to kilometer 56.300 (existing km 4.627 to km 56.30) of National Highway number 218 (New NH -52) in the State of Karnataka and authorises the National Highways Author ity of India to collect, either through its officials or through a contractor, the said fee, namely: - Table -1 Type of vehicle Base rate of fee per km for the base year 2022 -23 (in Rupees) (1) (2) Car, Jeep: Van or Light Motor Vehicle 0.96 Light Commerc ial Vehicle Light Goods Vehicle or Mini Bus 1.55 Bus or Truck (Two Axles) 3.26 Three -axle commercial vehicles 3.55 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) or Multi Axle Vehicle (MAV) (four to six axles) 5.11 Oversized Vehicle s (seven or more axles) 6.22 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non -Commercial purposes and resides within a distance of twenty k ilometers from the fee plaza is Rs. 330 (Rupees three hundred and thirty only) for the year 2023 -24 and is subject to revision every year as per the provisions of the said rules. 4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: - Table - 4 Amount Payable Maximum number of one -way journeys allowed Period of validity One and one -half times of the fee for one way journey Two Twenty -four hours from the time of payment Two-third of amount of the fee pa yable for fifty Single journeys Fifty One month from date of payment 5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that ca tegory of vehicle provided no service road or alternative road is available for use of such. 6. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub -rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been rem oved from such mechanical vehicle. 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 9. Based on the base rate of fee per kilometer for the base year 2007 -08 as mentioned inTable -1 above, the actual amount of fee to be charged fro m the mechanical vehicles and the discounts will be calculated by the National Highway Authority of India on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be publish ed in at least one newspaper in English and vernacular language. 10. The estimated capital cost of the project is Rupees 220.40 Crore. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately]. The National Highway Authority of India shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee levi able shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
