The draft amends the Explosives Rules, 2008: in rule 2, it inserts new definitions of 'Defence Explosives' (clause 15A, explosives for the defence sector manufactured by private manufacturers), 'Micro and Small Enterprises' (clause 35B, as defined in the Micro, Small and Medium Enterprises Development Act, 2006), 'startup' (clause 54A, as defined in DPIIT notification G.S.R. 127(E) dated 19th February 2019) and 'women entrepreneur' (clause 61A, an enterprise with at least 26 percent capital owned and controlled by a woman); in rule 5, it adds sub-rule (4) making STEC-pamphlet safety distances applicable to defence explosives; in rule 9(1), it extends coverage to 'proposed new' establishments; in the rule 113 table, it inserts new serial 27 creating a 'Permission (R&D)' category (Form AE-13) for manufacture, storage and use of up to 5 kg of explosives for R&D purposes, listing required documents; in Schedule IV Part I, it adds a corresponding article 13 naming the Chief Controller of Explosives as the granting authority; and in Schedule V, it inserts new Form AE-13, an application form for R&D permission. The notification records that the principal Explosives Rules, 2008 were published vide G.S.R. 907(E) dated 29th December 2008 and subsequently amended vide G.S.R. 65(E) dated 24th January 2011, G.S.R. 772(E) dated 11th December 2013, G.S.R. 17(E) dated 9th January 2019, G.S.R. 633(E) dated 11th October 2024 and G.S.R. 284(E) dated 24th April 2025. MINISTRY OF COMMERCE AND INDUSTRY (Department for Promotion of Industry and Internal Trade) NOTIFICATION New Delhi, the 19th February, 2026 G.S.R. 143(E).— The draft of the following rules to amend the Explosives Rules, 2008, which the Central Government proposes to make in exercise of the powers conferred by sections 5 and 7 of the Explosives Act, 1884 (4 of 1884), is hereby published as required by sub-section (1) of section 18 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft shall be taken into consideration after Thirty (30) days from the date on which the copies of Gazette of India containing this notification are made available to the public; Objections or suggestions, if any, to these draft rules may be sent to the Director (Explosives), Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, Room No. 252A Udyog Bhavan, New Delhi –110 011 or email: [email protected]; within the period specified above. The objections or suggestions which may be received from any person with respect to the said draft rules, within the period so specified will be considered by the Central Government. 1. (1) These rules may be called the Explosives (Amendment) Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Explosives Rules, 2008 (hereinafter referred to as the said rules),in rule 2: - (a) after clause (15), the following clause shall be inserted, namely: - ‘(15A) “Defense Explosives” means explosives which is meant for defense sector and manufactured by private manufacturers’; (b) after clause (35A), the following clause shall be inserted, namely: - ‘(35B) “Micro and Small Enterprises” means an enterprise defined in clause (h) and clause(m) of section 2 of the Micro, Small and Medium Enterprises Development Act, 2006’; (c) after clause (54), the following clause shall be inserted, namely: - ‘(54A) “startup” means an entity registered with the Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry and as defined in clause (a) of Paragraph 1 of the Notification number G.S.R. 127(E), dated the 19th February, 2019, and as amended from time to time’; (d) after clause (61), the following clause shall be inserted, namely: - ‘(61A) “women entrepreneur” means an enterprise owned and controlled by a woman having a minimum financial interest of 26 percent of the capital’; 3. In rule 5 of the said rules, after sub-rule 3, the following clause shall be inserted, namely: - ‘(4) for defense explosives safety distances mentioned in the relevant STEC pamphlets shall be applicable.’ 4. In rule 9, in sub-rule 1 of the said rules, after the word “established” the words “or proposed new” shall be inserted. 5. In case of MSME,certificate issued by the Ministry of Micro, Small and Medium Enterprises or in case of Startup, documentary evidence towards registration with the Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry or in case of Women Entrepreneur, documentary evidence towards Proprietor or Director of the firm or company. | i.
