NOTIFICATION
New Delhi, the 18th October, 2023
G.S.R. 788 (E).—In exercise of the powers conferred by section 56 read with sub -section (5) of section 4 of
the Energy Conservation Act, 2001 (52 of 2001), the Central Government, hereby makes the following amendments in
the Bureau of Energy Efficiency (Appointment o f Members, Manner of Filling Vacancies, Fees and Allowances and
Procedure For Discharging Their Functions) Rules, 2007 (hereinafter referred to as the principal rules), namely: -
1. Short title and commencement. – (1) These rules may be called the Bureau of Energy Efficiency (Appointment of
Members, Manner of Filling Vacancies, Fees and Allowances and Procedure For Discharging Their Functions)
(Amendment), Rules 2023.
(2) They shall c ome into force on the date of their publication in the Official Gazette.
2. In the Bureau of Energy Efficiency (Appointment of Members, Manner of Filling Vacancies, Fees and
Allowances and Procedure For Discharging Their Functions) Rules, 2007, in rule 3, -
(i) in sub -rule (1), for clause (a), the following clause shall be substituted, namely: -
“(a) one official each from the energy or power department of five States from the five regions, not
below the rank of Principal Secretary to the State Government as mem ber under clause (o) of sub -
section (2) of section 4 of the Act.”;
(ii) the sub -rule (2) shall be omitted;
(iii) for sub -rule (3), the following sub -rules shall be substituted, namely: -
“(3) For the purpose of clause (b) of sub -rule (1), the Central Go vernment shall appoints in the
following manner, namely: -
(a) One or two person having adequate knowledge, experience or capability in dealing with matters
relating to promotion of energy efficiency or energy conservation, who in the opinion of the Central
Government is capable of representing industry;
(b) One or two person having adequate knowledge, experience or capability in dealing with matters
relating to promotion of energy efficiency or energy conservation, who in the opinion of the Central
Governme nt is capable of representing equipment and appliance manufacturers;
(c) One or two person having adequate knowledge, experience or capability in dealing with matters
relating to promotion of energy efficiency or energy conservation, who in the opinion of the Central
Government is capable of representing architects;
(d) One or two person having adequate knowledge, experience or capability in dealing with matters
relating to promotion of energy efficiency or energy conservation, who in the opinion of the Cen tral
Government is capable of representing institutes;
(e) One or two person having adequate knowledge, experience or capability in dealing with matters
relating to promotion of energy efficiency or energy conservation, who in the opinion of the Central
Government is capable of representing consumers;”.
(iv) In sub -rule (4), for clause (a), the following clause shall be substituted, namely: -
“(a) Major energy users like Micro, Small and Medium Enterprises, Heavy Industries, Commerce and
Industry, Science an d Technology and Fertilizers”.
