By Notification No. 12/2025-Customs (ADD), G.S.R. 305(E), dated 10th May 2025, the Ministry of Finance (Department of Revenue) imposes anti-dumping duty on 'Titanium Dioxide' falling under tariff items 2823 00 10, 3206 11 10 and 3206 11 90 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), originating in or exported from China PR, when imported into India. The action follows the designated authority's final findings in notification F. No. 6/03/2024-DGTR dated 12th February 2025 (published in the Gazette of India, Extraordinary, Part I, Section 1, same date), which concluded that the subject goods were exported at dumped prices, causing material injury to the domestic industry. The duty is imposed under sub-sections (1) and (5) of section 9A of the Customs Tariff Act read with rules 18 and 20 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995. Duty amounts, in USD per metric tonne, are specified against named Chinese producers: Anhui Gold Star Titanium Dioxide (Group) Co., Ltd. and its trading arm (USD 609/MT); Shandong Jinhai Titanium Resources Technology Co., Ltd. and Shandong Xianghai Titanium Co., Ltd. (USD 563/MT); the LB Group entities (LB Xiangyang, LB Sichuan, LB Lufeng Titanium Industry Co., Ltd., LB Group Co., Ltd.) and Henan Billions Advanced Material Co., Ltd. (USD 460/MT); twelve named non-sampled cooperative producers (USD 510/MT); all other producers from China PR (USD 681/MT); and goods originating elsewhere but exported from China PR, or vice versa (USD 681/MT). The notification lists specific exclusions from the product scope, covering titanium dioxide used in food additives, pharmaceutical tablet film coatings, cosmetics/sunscreens, textile and fibre production, and nano or ultrafine titanium dioxide below 100 nm particle size. The duty is levied for five years from the date of publication unless revoked, superseded or amended earlier, and is payable in Indian currency at the exchange rate notified under section 14 of the Customs Act, 1962 (52 of 1962), applicable as on the date of presentation of the bill of entry under section 46 of that Act. CG-DL-E-10052025-263034 EXTRAORDINARY PART II—Section 3—Sub-section (i) 3115 GI/2025 (1) MINISTRY OF FINANCE (Department of Revenue) NOTIFICATION New Delhi, the 10th May, 2025 No. 12/2025-Customs (ADD) G.S.R. 305(E).— Whereas in the matter of “Titanium dioxide” (hereinafter referred to as the subject goods) falling under tariff items 2823 00 10, 3206 11 10 and 3206 11 90 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975) (hereinafter referred to as the Customs Tariff Act), originating in, or exported from China PR (hereinafter referred to as the subject country), and imported into India, the designated authority in its final findings vide notification F. No. 6/03/2024-DGTR, dated the 12th February, 2025, published in the Gazette of India, Extraordinary, Part I, section 1, dated the 12th February, 2025, has come to the conclusion that- (i) the subject goods have been exported to India from the subject country at dumped prices; (ii) the domestic industry has suffered material injury on account of subject imports from the subject country; (iii) the material injury has been caused by the dumped imports of the subject goods from the subject country; and has recommended imposition of an anti-dumping duty on the imports of subject goods, originating in, or exported from the subject country and imported into India, in order to remove injury to the domestic industry. Now, therefore, in exercise of the powers conferred by sub-sections (1) and (5) of section 9A of the Customs Tariff Act read with rules 18 and 20 of the Customs Tariff (Identification, Assessment and Collection of Anti- dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, the Central Government, after considering the aforesaid final findings of the designated authority, hereby imposes on the subject goods, the description of which is specified in column (3) of the Table below, falling under tariff items of the First Schedule to the Customs Tariff Act as specified in the corresponding entry in column (2), originating in the countries as specified in the corresponding entry in column (4), exported from the countries as specified in the corresponding entry in column (5), produced by the producers as specified in the corresponding entry in column (6), and imported into India, an anti-dumping duty equal to the amount as specified in the corresponding entry in column (7), in the currency as specified in the corresponding entry in column (9) and as per unit of mesasurement as specified in the corresponding entry in column (8) of the following of the Table, namely:- TABLE | Sl.
