Detailed Summary

By notification S.O. 3208(E) dated 7 August 2024, issued under section 7 of the National Highways Act, 1956 (48 of 1956) read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, the Ministry of Road Transport and Highways levies a fee on mechanical vehicles for use of the Jammu Ring Road (NH-244A, a bypass of NH-44) in the Union Territory of Jammu & Kashmir, from design Kilometre -0.687 to design Kilometre 57+568 (existing Kilometre 86 of the Pathankot-Jammu Section to existing Kilometre 15+068 of the Jammu-Srinagar Section), and authorises the National Highways Authority of India ('the Authority') to collect the fee, itself or through a contractor. The highway had earlier been entrusted to the Authority by notification S.O. 5100(E) dated 30 November 2023 issued under section 11. Base rates per Kilometre for 2007-08 are specified by vehicle category, from Rs. 0.65 for cars/jeeps/vans/mini buses up to Rs. 4.20 for oversized vehicles of seven or more axles; a two-lane ramp of 0.166 Km near village Dondpur (fee plaza at Km/Ch. 21+450, District Jammu) is charged at 60% of the base rate, and the 52.853-Km four-lane Jammu Ring Road bypass (costing Rs. 1942.03 crore) is charged at 150% of the base rate. An additional fee applies for structures over 60m long (bridges, flyovers, a viaduct and tunnels T-1 and T-2 between Km 50.713-54.700), converted to equivalent road length by a 10x equalisation factor: 43.47 Km equivalent (from 4.347 Km of structures) at 100% of the base rate, and 0.84 Km equivalent (from a 0.084 Km two-lane flyover) at 60%. Commercial vehicles registered in the district where the fee plaza falls get a 50% discount where no service or alternative road is available; overloaded vehicles must pay an additional fee under sub-rule 1A of the Rules and may not use the section until the excess load is removed. The estimated capital cost of the project is Rs. 1861.36 crore, subject to variation as land acquisition, utility shifting and tree cutting are yet to be completed; the Authority must record capital-cost recovery through the user fee and revise rates annually under rule 5 of the Rules. Fee for commercial vehicle (excluding vehicles plying under National Permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collection agency, equal to the fee specified in sub-rule 1A of the said rules, and shall not be entitled for make use of the highway section unless the excess load has been removed from such mechanical vehicles. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc shall be as per definitions specified in the said rules. 9. The rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 10. Based on the base rate of fee per Kilometre for the base year 2007-08 as mentioned in Table-1, above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 11. The estimated capital cost of the project is Rupees 1861.36 Crore. The Capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed.
