Exercising powers under sub-section (1) and clause (t) of sub-section (2) of section 54, read with sub-section (1) of section 38, of the Dam Safety Act, 2021 (41 of 2021), the National Dam Safety Authority, acting on the recommendations of the National Committee on Dam Safety, notified the Independent Panel of Experts for Comprehensive Dam Safety Evaluation of each specified dam Regulations, 2025 (F. No. TE-32/2/2023-NDSA-MOWR), dated 23rd May 2025, effective from the date of their publication in the Official Gazette. The regulations require each specified dam owner (other than for interstate specified dams where the Authority itself is the State Dam Safety Organisation) to constitute an independent panel of at least three key experts, including a mandatory dam safety expert, drawn from working or retired officials of Central Government organisations, State Governments, Public Sector Undertakings, IITs/NITs, reputed private institutions, or freelance experts, all free of conflicts of interest. Table 1 of the regulations prescribes minimum qualifications and experience, generally a relevant Bachelor's or Master's engineering/science degree plus at least ten years of professional experience, for eight categories of experts: Dam Safety Expert, Design Expert, Construction Supervision Expert, Geologist, Hydrologist, Hydro-Mechanical Expert, Instrumentation Expert, and Seismic Expert. CG-DL-E-04062025-263596 EXTRAORDINARY PART III—Section 4 3624 GI/2025 (1) NATIONAL DAM SAFETY AUTHORITY NOTIFICATION New Delhi, the 23rd May, 2025 F. No.TE-32/2/2023-NDSA-MOWR.—In exercise of the powers conferred by sub-section (1) and clause (t) of sub-section (2) of section 54 read with sub-section (1) of section 38 of the Dam Safety Act, 2021 (41 of 2021), the National Dam Safety Authority, on the recommendations of the National Committee on Dam Safety, hereby makes the following regulations, namely: - 1. Short title and commencement. – (1) These regulations may be called the Independent Panel of Experts for Comprehensive Dam Safety Evaluation of each specified dam Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions. - (1) In these regulations, unless the context otherwise requires, - (a) ―Act‖ means the Dam Safety Act, 2021(41 of 2021); (b) ―Authority‖ means the National Dam Safety Authority established under section 8 of the Act. (2) Words and expressions used herein and not defined in these regulations but defined in the Act, shall have the meanings respectively, assigned to them in the Act. 3. Independent panel of expert for comprehensive dam safety evaluation of each specified dam.—The composition of Independent Panel of expert for the purpose of determining the condition of the specified dam and its reservoir are as follows: — (1) The independent panel of experts shall consist of key experts- such as Chairperson and Members. (2) The number of key experts in the panel shall be identified based on the identified or known dam safety issues and hazards associated with the dam, however in no case independent panel of experts shall consist of less than three key experts with mandatory presence of dam safety expert and the details of qualifications and skillsets required for the experts of the panel are elucidated in Table 1. (3) The Chairperson and Members of independent panel of experts may comprise of working as well as retired officials from the Central Government Organisations, State Governments, Public Sector Undertakings, Indian Institute of Technology/National Institute of Technology, reputed private institutions, reputed freelance experts. (4) The Chairperson and Members of independent panel of experts shall be free from conflicts of interest, including financial, professional, or personal ties that could bias their judgment and it shall be ensured that the panel members do not have any direct involvement with the entities or interests affected by their work. (5) Each specified dam owners other than interstate specified dams for which Authority is the State Dam Safety Organisation, shall constitute an independent panel of experts and in case of the interstate specified dams for which Authority is the State Dam Safety Organisation, the head of the concerned State Dam Safety Organisation shall constitute the panel. (6) The experts shall be classified on the basis of their qualifications and experience in the respective field of specialisation and the eminence in their profession as given in Table-1.
