No. 01/89/180/42/AM-25/PC-2[A]/E-43560), issued by the Directorate General of Foreign Trade under paragraph 1.03 and 2.04 of the Foreign Trade Policy, 2023, as amended, amends Para 2.35 of the Handbook of Procedures, 2023 with immediate effect. Previously, the provision allowed a Regional Authority (RA) to issue an end-user certificate under Appendix 2Q of Appendices and Aayat Niryat Forms, based on an application under ANF 2J, where a foreign government insisted on end-user certification before permitting export of a freely importable item to India. The amendment extends this to cover both Free and Restricted items, renames the certificate the End User Certificate (EUC), and adds a proviso that for restricted items the EUC may be issued by the RA only for items covered by a valid restricted authorisation granted by DGFT, with the quantity and value in the EUC limited to that specified in the restricted authorisation. The stated effect of the Public Notice is that Regional Authorities are authorised to issue an EUC for restricted import items strictly in accordance with the restricted authorisation granted by DGFT. The certificate shall be issued based on an application made under ANF 2J, along with documents prescribed therein. Provided further that, in the case of import of restricted items, the EUC shall be issued by RA only for those items in respect of which a restricted authorisation has been granted by DGFT and is valid.
